AN OUTLINE OF THE BANKRUPTCY PROCESS

STEP ONE:
Your first step in filing a Chapter 7 Bankruptcy is to make sure you qualify and go over what it means to file Chapter 7 Bankruptcy.

STEP TWO:
Pay your fees. At your consultation you will be quoted a price for filing Chapter 7 with our office, including the attorney fees and all costs associated with your case.

STEP THREE:
Complete your first Credit Counseling Course. You will be given login information to do this.

STEP FOUR:
Once you have completed the first course, you will need to complete the packet given to you. The packet will contain additional information that we need from you to complete your petition. DO NOT DO ANYTHING THAT WILL CHANGE YOUR FINANCIAL STATUS AS OF THE DATE OF YOUR APPOINTMENT.

STEP FIVE:
You will attend your signing appointment. We will go over your petition with you to make sure everything is accurate. If something needs to be corrected, it will be done at this stage.

STEP SIX:
We will file your case with the court and send you a letter with your court date, time of court, case number and Trustee. You will also get a notice from the Court.

STEP SEVEN:
Attend your court hearing (also called the creditor’s meeting). Make sure that you bring your driver’s license and social security card with you at your court hearing or your case will be rescheduled by the Court.

STEP EIGHT:
Complete your second counseling class. You will use the same login information used from your first Credit Counseling Course. This class must be completed within 45 days of your court appearance or the court may dismiss your case and your debts will not be discharged. You would have to start all over again if you fail to do this, including payment in full a second time.

STEP NINE:
The court will issue your discharge and we will send you a letter letting you know when this occurs. Your discharge is the clearing of your debts and usually comes within 70 days of your court hearing.

STEP TEN:
The Court will close your case once the trustee has made their final report. There is no time frame on this but often occurs within 30 days of your discharge.

STEP ELEVEN:
Work on rebuilding your credit and enjoying your “fresh start”.
